1. Recovery, Transport & Storage
- Quotes are based on customer-supplied information.
- Additional charges may apply for non-runners, locked steering, lowered vehicles, accident damage, restricted access or undeclared faults.
- Winching, skates, specialist equipment or extended labour is chargeable.
- Aborted call-outs are chargeable.
Storage is charged at £28 per day.
Vehicles may be retained under lien until all charges including storage are paid in full.
2. Vehicle Condition & Evidence
- Vehicle condition is recorded at time of collection where reasonably possible.
- Photographic evidence taken at collection or delivery is deemed accurate unless disputed within 24 hours.
- Customers are responsible for undeclared mechanical failure during loading or unloading.
3. Acceptance of Terms
These Terms are accepted when the vehicle is:
- Loaded onto our recovery vehicle,
- Placed into our care or custody,
- Delivered to our workshop or storage facility.
A physical signature is not required for these Terms to be binding.
4. Membership
- Subject to fair use and geographic limits.
- No cover for pre-existing faults.
- Repeated call-outs for unresolved issues may be chargeable.
- Missed payments may result in suspension.
5. Workshop Services
- Diagnostics may uncover further faults.
- Parts are covered by manufacturer warranty only.
- Vehicles uncollected after completion may incur £28 per day storage.
6. Trade, Auction & Salvage
- Dealer and auction vehicles transported as presented.
- No liability for undisclosed damage or missing parts.
- Salvage vehicles transported at owner’s risk.
7. Right to Refuse & Subcontract
- We reserve the right to refuse unsafe or unlawful instructions.
- We may subcontract recovery or transport where necessary.
8. Personal Belongings & Security
Customers must remove valuables. We are not liable for items left inside vehicles.
9. Electric & Hybrid Vehicles
Customers must declare battery damage. We are not liable for latent battery faults or thermal events.
10. Chargebacks & Debt Recovery
- Unjustified chargebacks may result in recovery action.
- Customers are liable for chargeback fees and administrative costs.
- Outstanding debts may be referred to collection agencies or legal proceedings.
- Reasonable legal and recovery costs may be added to outstanding balances.
11. Liability & Indemnity
Liability is limited to our insurance cover. Customers indemnify DSBM AUTO CENTER LTD against claims arising from undisclosed defects or lack of authority.
12. Governing Law
These Terms are governed by the laws of Scotland and subject to Scottish courts.
